Mr. Swain graduated from Franklin and Marshall College (B.A. 1980), and obtained his Juris Doctor degree from Tulane University School of Law, cum laude, in 1983. He served as a law clerk to Chief Judge Nauman S. Scott, U.S. District\n Court for the Western District of Louisiana from 1983-1985.<\/p>\n

In 1985, Mr. Swain associated with Lemle & Kelleher (New Orleans), and enrolled in the LL.M. in Admiralty Program at Tulane. In 1987, he joined Graham & James (Long Beach), where he worked before forming Swain & Dipolito.\n Mr. Swain is listed in The Best Lawyers in America in 2009, 2010, and 2011.<\/p>\n

Mr. Swain handles legal matters in all sub-disciplines of admiralty and maritime law. He specializes in cargo defense and marine casualty matters, as well as longshore personal injury, seaman claims, passenger suits, oil pollution,\n vessel mortgage foreclosures, FD&D matters, hull insurance claims, limitation of liability, maritime liens and claims, tugs and towage, collision, and shipping regulation. Marine terminal operations, warehouses, NVOCC\u2019s, and\n multi-modal carriage are an integral part of Mr. Swain\u2019s practice. Throughout his career, he has been involved in handling major casualties, including the Pacbaroness\/Atlantic Wing collision and the American Trader oil spill.<\/p>\n

Mr. Swain has served as a port correspondent for many P&I Clubs in the International Group. He is a Proctor member of the Maritime Law Association and serves on the Carriage of Goods Committee. Mr. Swain is admitted to practice\n in California and Louisiana.<\/p>\n
